Acceptance of Terms

FastVirtual provides this service subject to the following Terms, which may be updated from time to time without notice. The most current version of this document is available at http://www.fastvirtual.com/company/policies/directory_terms.html.

In addition, when using FastVirtual's Directory service, you and FastVirtual are subject to any posted guidelines or rules applicable to this service which may be posted from time to time. All such guidelines or rules (including but not limited to our Standard Policies) are hereby incorporated by reference into this document. FastVirtual may also offer other services that are governed by different Terms of Service. For instance, different terms apply to FastVirtual's Web Hosting Services, Domain Name Registration Services and Internet access services.

Description of Service

You understand and agree that this service is provided "as-is" and that FastVirtual assumes no responsibility for the timeliness, deletion, or failure to store any user information. You are responsible for obtaining access to the service and that access may involve third party fees (such as Internet service provider or airtime charges), for which you are responsible.

Your Listing Obligations

You agree to: (a) provide true and accurate information, and (b) maintain and update this information to keep it true and accurate. If you provide any information that is untrue or inaccurate, or FastVirtual has reasonable grounds to suspect that such information is untrue or inaccurate, FastVirtual has the right to remove your link and refuse future use of this service.

You also acknowledge and confirm that the web site you submit for inclusion in the Directory does not contain adult or offensive material.

Should you add a link to FastVirtual on your web site, you acknowledge that the link will be styled and worded as specified by FastVirtual's acceptable link options, available here:

Content Submitted to the Directory

FastVirtual does not claim ownership of content you submit or make available for inclusion in the Directory. However, with respect to content provided in this publicly accessible area, you grant FastVirtual the world-wide, royalty free and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content solely for the purposes of providing and promoting the service in which such content was submitted or made available. This license exists only for as long as you elect to continue to include such content within this service and will terminate at the time you remove or FastVirtual removes such content from this service.

Indemnity

You agree to indemnify and hold FastVirtual and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through this service, your use of this service, your connection to this service, your violation of the Terms of Service, or your violation of any rights of another.

Modifications to Service

FastVirtual reserves the right at any time to modify or discontinue, temporarily or permanently, the Directory service (or any part thereof) with or without prior notice. You agree that FastVirtual shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Directory service.

Links

This service provides links to other web sites or resources. Because FastVirtual has no control over such web sites and resources, you acknowledge and agree that FastVirtual is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such web sites or resources. You further acknowledge and agree that FastVirtual shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web site or resource.
